1. Agreement to these Terms
These Terms of Service ("Terms") govern your access to and use of Wire Chord Studio(the "Service") available at wirechord.com and associated subdomains.
The Service is operated by VladyslavTysiachnyi Web Solutions, based in Poland("we," "us," or "our").
By creating an account, joining a jam room, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Who may use the Service
You must be at least 13 years old (or the minimum age required in your country to consent to online services) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
You are responsible for ensuring that your use of the Service complies with applicable laws, including rules that apply to online performances, copyright, and export controls where you live.
3. The Service
Wire Chord Studio provides browser-based rooms for real-time collaborative music jamming, including transmission of MIDI data and optional voice chat between participants. Room availability, latency, audio quality, and feature availability may vary based on your device, browser, network, and server load.
We may offer free and paid plans. Features, limits, and pricing are described on the Service and may change over time. We will provide reasonable notice before material changes to paid plans affect your subscription.
4. Accounts
Some features require an account. You agree to provide accurate registration information and to keep your credentials confidential. You are responsible for all activity that occurs under your account.
Notify us promptly at wirechordstudio@gmail.com if you suspect unauthorized access. We may suspend or terminate accounts that appear compromised or that violate these Terms.
5. Acceptable use
You agree not to misuse the Service. For example, you must not:
- Harass, threaten, impersonate, or abuse other users.
- Transmit unlawful, infringing, or harmful content through rooms, chat, or usernames.
- Attempt to disrupt rooms, overload infrastructure, scrape data, or bypass security or access controls.
- Reverse engineer, copy, or resell the Service except as expressly permitted by law.
- Use the Service in a way that interferes with other users' real-time musical collaboration.
We may investigate violations and remove content, restrict access to rooms, or terminate accounts at our discretion, with or without notice where necessary to protect users or the Service.
6. Jam rooms and user content
You retain ownership of content you create or perform while using the Service, including the musical material You grant VladyslavTysiachnyi Web Solutions a limited, worldwide, non-exclusive license to host, transmit, and technically process that content solely to operate the Service—for example, to relay MIDI and audio between participants in a room you join.
Room links, passwords, and participant lists are provided for collaboration among people you choose to invite. Do not share access credentials publicly unless you intend for others to join.
7. Subscriptions and payments
Paid plans, when available, are billed through Stripe, Inc. ("Stripe"). By subscribing, you also agree to Stripe's applicable terms and privacy practices for payment processing. We do not store your full payment card number on our servers.
Subscription fees are charged in advance for each billing period shown at checkout. Unless stated otherwise at purchase, subscriptions renew automatically until you cancel. You can cancel through account settings or by contacting us; cancellation takes effect at the end of the current billing period unless required otherwise by law.
Refunds are handled according to the policy displayed at purchase and applicable consumer laws. Chargebacks should be raised with us first so we can help resolve billing issues.
8. Free tier advertising
If you use a free plan, we may display small, non-intrusive banner advertisements within the Service. Ads help keep free jamming available. Paid subscribers will not see these banner ads as part of their subscription benefits, unless we state otherwise for a specific plan.
Advertising partners may use cookies or similar technologies to deliver and measure ads, as described in our Privacy Policy. We do not sell your email address to advertisers or other third parties for their own marketing lists.
9. Intellectual property
The Service, including software, branding, design, and documentation, is owned by VladyslavTysiachnyi Web Solutions or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to refer to the Service in a truthful, non-misleading way.
Instrument samples, third-party libraries, and open-source components used in the Service remain subject to their respective licenses.
10. Third-party services
The Service relies on third-party providers for hosting, networking, payments (Stripe), analytics, and advertising. Your use of those features may be subject to additional third-party terms. We are not responsible for third-party services we do not control.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW,VladyslavTysiachnyi Web Solutions DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Real-time music collaboration depends on networks and devices we do not control. We do not guarantee uninterrupted, error-free, or perfectly synchronized performance.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VladyslavTysiachnyi Web Solutions AND ITS SUPPLIERS AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In that case, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless VladyslavTysiachnyi Web Solutions from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, sections that by their nature should survive will remain in effect, including payment obligations, disclaimers, limitations of liability, and indemnification.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires a different form of consent.
16. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer in the European Union, you also benefit from mandatory protections of the law of your country of residence where they apply.
Disputes should first be raised with us at wirechordstudio@gmail.com so we can try to resolve them informally. Where permitted by law, courts in Poland have jurisdiction over disputes relating to these Terms and the Service.
